TRAFFIC OFFENCES
I have been charged with a PCA, what does this mean?If you are a full license driver and are driving a motor vehicle on a public road, your blood alcohol concentration must be below the limit of 0.05grams of alcohol per 100mls of blood. If you are over the "Prescribed Concentration of Alcohol" (or PCA) you will be charged with a drink driving offence. As your PCA increases, so does the severity of your penalty.
I have been suspended for speeding, do I have a chance of getting my license back sooner?Yes, generally, if it is your first offence/have a good driving record, and the loss of license will cause financial and emotional hardship on you and your dependants, the Court has the discretion to reduce your penalty or waive the penalty altogether. Upon appraisal of the circumstances of your offence, our lawyers will advice you on your outcomes of success.
What is a Section 10?Section 10 refers to the Section of the Crimes (Sentencing Procedure) Act 1999 which gives a Court that finds you guilty of a traffic offence the power to discharge you without recording a conviction. As there is no conviction, there is no subsequent criminal record against your name.
