PROPERTY LAW

The two most common areas of property law includes
1. Conveyancing – the sale and purchase of a property or business in NSW2. Leasing – an agreement to rent property from the owner or lease property to tenants.
We find that in most circumstances, a client’s first ever contact with a solicitor will occur when they are buying or selling their home.
Depending on whether we are instructed to act for the seller (vendor) or the buyer (purchaser) our role includes:
  • Preparing the contract for sale
  • Ordering a Building & Pest Report on a property
  • Ordering a Strata Report on a property
  • Reviewing the entire Contract including any special conditions
  • Ensuring your finance is unconditionally approved
  • Exchanging contracts
  • Attending to either stamp duty exemption or payment of stamp duty
  • Reviewing loan and mortgage documents
  • Preparing settlement figures
  • Attending settlement to ensure a smooth completion of your sale or purchase

Buying or selling a residential or commercial property is a big decision and a significant matter for most people. SUCCESSION LAW (WILLS & ESTATES)

The area of succession law concerns what will happen to your assets in the event of your death, management of finances and/or health and lifestyle decisions while you are still alive but incapable of managing these issues.

When considering your Will we strongly recommend that you also put in place plans for any future incapacity through Power of Attorney and Guardianship documents. This will ensure that if you somehow become unable to make decisions about your finances, your medical treatment or living arrangements then the person or persons who you trust to make these decisions can do so unhindered.

TRAFFIC OFFENCES

A driving offence occurs when someone driving a vehicle, or someone in a vehicle, breaks a law. A driver includes a rider, for example a person riding a motorbike or bicycle.
If you commit a driving offence, you may be fined and/or charged.
If you have been charged with a more serious driving offence, you might receive a CAN, and you will have to go to the Local Court. This is where you will need legal representation to achieve th ebest possible outcome.
Some of the more serious driving offences include:
  • Negligent driving, occasioning death or grievous bodily harm
  • Exceeding the speed limit by more than 30 km/hr over the limit
  • Driving with the prescribed concentration of alcohol (PCA) in your blood or breath (including low range, mid range and high range)
  • Driving under the influence of drugs or alcohol
  • Refusing to undergo a breath test
  • Driving while your licence is suspended or you are disqualified from driving.

CIVIL LITIGATION AND DISPUTE RESOLUTION

Civil litigation is a legal dispute between two or more parties that seek money, damages or specific performance rather than criminal sanctions. It covers many areas of law including: compensation law, deceased estates, debt recovery and most others disputes.

At The Parks Legal we understand that parties involved in disputes about money often do not have the resources to spend trying to recover a debt or defend a debt recovery claim, so we explore every alternative to court on behalf of our clients. These avenues are called Dispute Resolution processes.
Dispute Resolution processes fall into two major types: Adjudicative processes, such as litigation or arbitration, in which a judge, jury or arbitrator determines the outcome. Consensual processes, such as collaborative law, mediation, conciliation, or negotiation, in which the parties attempt to reach agreement. The latter options are generally the best way to approach issues as they are cost effective, quicker, and allow the parties more options in terms of solutions.
